Concerta Class Action

|

Concerta Class ActionConcerta (methylphenidate) is a popular prescription medication for the treatment of attention-deficit hyperactivity disorder (ADHD). Unfortunately, several studies have linked Concerta to higher rates of priapism, cardiovascular risks, psychiatric disorders, and other severe side effects. If you need information about joining a Concerta class action or filing an individual lawsuit, contact Schmidt & Clark, LLP.

If you file a lawsuit or join a class action, you could receive compensation for your child’s injury, medical expenses, and more.

Concerta and Priapism

Concerta contains methylphenidate, the same active ingredient in Ritalin and many other ADHD drugs. From 1997 through 2012, this class of drugs has been associated with 15 cases of priapism — a painful, long-lasting, and unwanted erection that is not due to sexual arousal, and can cause permanent erectile dysfunction. Of the 15 cases, 12 occurred in children (median age 12.5 years).

The FDA published a Drug Safety Communication and recommended that parents and caregivers of male children on Concerta should talk about the symptoms of priapism and what to do if they occur.

Children who do not recognize symptoms or are too embarrassed to tell an adult can potentially develop severe tissue damage in the penis, which may need to be treated with hospitalization and/or surgery. Without treatment, priapism cause lifelong erectile dysfunction (impotence).

Concerta Heart Risks

  • Sudden death
  • Heart rhythm abnormalities
  • Stroke
  • Heart attack
  • Cardiomyopathy
  • High blood pressure (hypertension)

What is the problem?

Schmidt & Clark, LLP is nationally recognized as a class action law firm, but we are not filing a Concerta class action at this time. Instead, we are filing individual lawsuits on behalf of adults and children who developed priapism, heart problems, and other severe side effects.

About Class Actions

Class actions are ideal when a large group of people is injured by the same defendant. They are especially useful when each individual is seeking damages that are less than the cost of individual litigation. In a class action, members consolidate their claims into one representative lawsuit. Lawyers select one plaintiff to represent the whole group, and the success or failure of the class action is decided upon the outcome of that lawsuit.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Concerta Class Action

Although class actions can have advantages in certain circumstances, our lawyers are concerned that a Concerta class action could have serious disadvantages — plaintiffs could be forced to accept high attorneys’ fees and a “low ball settlement.” They may never get the opportunity to present their case before a judge and jury with a lawyer who is fighting on their behalf.

At Schmidt & Clark, LLP, we believe that individual Concerta lawsuits are the best way for us to fight for justice on each client’s behalf. We understand that many of our clients are suffering devastating injuries to their physical, financial, and emotional health. This is why we always review cases for free, and typically work on contingency-fee.
